Terms of Service — Maxisnap

These Terms of Service ("Terms") govern your use of the Maxisnap application, the Maxisnap Cloud service, the Maxisnap Studio self-hosted package, and the maxisnap.com website (collectively, the "Service"), which are operated by Broadfield Networks LLC, a Wyoming limited liability company ("Maxisnap", "we", "us", or "our"). By downloading, installing, purchasing, or using any part of the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By accessing or using Maxisnap, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using Maxisnap on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, for paying customers, send a notice to the email on file. Continued use of the Service after the change takes effect constitutes acceptance of the revised Terms.

2. Description of Service

Maxisnap is a screenshot capture and annotation tool for Windows (Windows only at present). The Service allows you to:

Capture screenshots of your screen, windows, or selected regions
Annotate screenshots with text, arrows, shapes, blur, numbered callouts, and other tools
Save screenshots locally or copy them to your clipboard
Upload screenshots to Maxisnap Cloud for shareable links, subject to our Privacy Policy
Upload screenshots to your own server (FTP, SFTP, S3-compatible object storage, or HTTP) using the Studio add-on
Self-host the Maxisnap Dashboard with the Studio add-on

3. Plans and Pricing

Free

Maxisnap's free tier includes local capture and annotation without an account. Cloud sharing requires an account; a free account includes 500 lifetime image uploads and 100 MB of lifetime video sharing. There are no watermarks or time-limited capture trials.

Pro — $18 per year (USD)

Maxisnap Pro is a recurring annual subscription priced at $18 USD per year. Pro adds unlimited Maxisnap Cloud uploads, ad-free share pages, 1-year retention on shared images, password-protected images, and per-image view analytics. Pro renews automatically at the same price every twelve months until you cancel. You can cancel at any time from your account dashboard or through the Stripe customer portal; cancellation takes effect at the end of your current paid period.

Studio — $20 one-time (USD)

Maxisnap Studio is a one-time purchase priced at $20 USD. It unlocks the "Add Your Own Server" upload backends (FTP, SFTP, S3-compatible, HTTP) and the Maxisnap Dashboard self-host package. Studio is not a subscription — it is a single charge with no recurring billing. Studio is associated with your Maxisnap account and is not transferable.

Currency, taxes, and fees

All prices are in U.S. Dollars. Where applicable, sales tax, VAT, or GST will be added at checkout based on your billing address and is collected on our behalf by our payment processor. Bank fees, credit card foreign-transaction fees, or currency-conversion fees imposed by your card issuer are your responsibility.

4. Payment, Billing, and Cancellation

Payments are processed by Stripe. By submitting payment information at checkout, you authorize Stripe to charge your selected payment method for the amount shown. We do not store full credit-card numbers, CVV codes, or other sensitive payment details on our servers. See our Privacy Policy for more on how payment data is handled.

For Pro subscriptions, your payment method will be automatically charged on each renewal date until you cancel. To cancel, sign in to your account dashboard and use the "Manage subscription" link, or open the Stripe customer portal directly from a billing receipt. Refunds are governed by our Refund Policy.

If a recurring charge fails, we will retry the charge a small number of times. If the payment continues to fail, your account will be downgraded to the free tier. You will not lose access to your screenshots or shared links — only Pro-only features will be disabled.

5. Acceptable Use

You agree to use Maxisnap only for lawful purposes. You may not use the Service to:

Capture, store, host, or share illegal content, including but not limited to child sexual abuse material, content that infringes intellectual-property rights, or content that violates applicable laws
Upload malicious files, malware, phishing pages, or content designed to exploit vulnerabilities in our infrastructure or in the systems of viewers
Harass, threaten, defame, or harm other individuals using content captured or shared through the Service
Attempt to reverse-engineer, decompile, or disassemble the Maxisnap application, except where this restriction is prohibited by applicable law
Use automated systems, bots, or scripts to interact with the Service in a manner that degrades performance for other users or circumvents our rate limits
Resell, redistribute, sublicense, or offer the Service or the Maxisnap Dashboard to third parties as a commercial product or service, without our written consent. This does not restrict Studio customers from re-skinning their own self-hosted Dashboard — changing its logo, colours, name, and domain — for their own use and for their own clients viewing links on it, which the Studio add-on expressly permits.
Circumvent or disable any security, license-enforcement, or access-control feature of the Service
Use the Maxisnap Cloud as a general-purpose file host, image CDN, or backup destination unrelated to screenshots

We reserve the right to remove uploaded content, suspend uploads, or terminate accounts that we reasonably believe violate these terms. Where appropriate we will notify you first; where the violation is severe or ongoing, action may be taken without prior notice.

DMCA / Copyright

Maxisnap Cloud lets users upload their own screenshots, so we operate a notice-and-takedown process under the US Digital Millennium Copyright Act.

A valid notice must include the standard DMCA elements: identification of the copyrighted work, the URL of the material you believe infringes it, your contact information, a statement that you have a good-faith belief the use is not authorised, a statement under penalty of perjury that the information is accurate and that you are the owner or authorised to act for the owner, and your physical or electronic signature.

We process valid notices promptly and will remove or disable access to the material. If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same agent, and we will follow the process set out in 17 U.S.C. § 512(g). We may terminate the accounts of users who repeatedly infringe.

6. Intellectual Property

Your content

You retain all rights to the screenshots and content you create using Maxisnap. We do not claim ownership of your captures. When you upload screenshots to Maxisnap Cloud, you grant us a limited, worldwide, royalty-free license to host, store, transmit, and display that content for the sole purpose of providing the sharing functionality you requested. This license ends when you delete the upload or when the upload's retention period expires.

Our software

The Maxisnap application, Maxisnap Studio package, Maxisnap Dashboard, the maxisnap.com website, our branding, and all associated source code, design, documentation, and marketing materials are the intellectual property of Maxisnap and are protected by applicable copyright, trademark, and other laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

7. Maxisnap Cloud Sharing

If you use Maxisnap Cloud to share screenshots, the following terms apply:

Uploaded screenshots are accessible via unique URLs. Anyone with the link can view the image. Pro users can password-protect uploads.
Free-tier uploads are retained for 30 days. Pro uploads are retained for 12 months. You may delete uploads at any time, and deletions are permanent.
We may remove uploaded content that violates these Terms or applicable law, in some cases without prior notice if the content is illegal or actively harmful.
Maxisnap Cloud is best-effort hosting. We work to keep it reliable, but we do not guarantee uninterrupted availability and we do not promise an uptime percentage. Do not rely on Maxisnap Cloud as your only copy of important screenshots.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
In no event shall Maxisnap, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or goodwill, arising out of or related to your use of the Service.
Our total aggregate liability for any claim arising from or related to the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim, or fifty U.S. Dollars, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Maxisnap and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

You may stop using Maxisnap at any time by uninstalling the application. If you have a Pro subscription, cancel it from your account dashboard before uninstalling to prevent further charges.

We may suspend or terminate your access to the Service at our discretion if we reasonably believe you have violated these Terms, are creating a security or fraud risk, or are abusing the Service in a way that harms other users. Where we are not legally prevented from doing so, we will give reasonable notice. Upon termination:

Your right to use the Service ceases immediately
Uploaded content will be retained for the standard retention period applicable to your tier, then deleted
Refunds, if any, are governed by the Refund Policy
Provisions of these Terms that by their nature should survive termination (including Sections 6, 8, 9, and 11) will survive

11. Governing Law and Disputes

Maxisnap is operated by Broadfield Networks LLC, a Wyoming limited liability company ("Broadfield Networks LLC"). References to "Maxisnap", "we", "us", and "our" in these Terms mean Broadfield Networks LLC.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles.

Disputes arising under or in connection with these Terms shall first be addressed through good-faith negotiation between you and us. If negotiation does not resolve the dispute within sixty (60) days, the dispute shall be resolved in the courts of competent jurisdiction in the governing-law location named above, unless mandatory consumer-protection law in your country of residence provides otherwise.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Maxisnap regarding your use of the Service. They supersede all prior agreements, understandings, and communications, whether written or oral.
