Terms of Service — Maxisnap

These Terms of Service ("Terms") govern your use of the Maxisnap application and related services (collectively, the "Service") operated by Maxisnap ("we", "us", or "our"). By downloading, installing, or using Maxisnap, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By accessing or using Maxisnap, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using Maxisnap on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify Pro subscribers of material changes by email.

2. Description of Service

Maxisnap is a screenshot capture and annotation tool for Windows. The Service allows you to:

Capture screenshots of your screen, windows, or selected regions
Annotate screenshots with text, arrows, shapes, blur, and other tools
Save screenshots locally or copy them to your clipboard
Upload screenshots to our cloud for shareable links (subject to our Privacy Policy)
Access additional features through a paid Pro subscription

3. Free and Paid Tiers

Free Tier

The free version of Maxisnap provides core screenshot capture and annotation features at no cost. There are no watermarks, no capture limits, and no artificial restrictions designed to force upgrades. The free tier is intended to be a fully functional tool.

Pro Tier

The Maxisnap Pro subscription provides additional features including custom server uploads (FTP, SFTP, S3), scrolling capture, and priority support. Pro subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). See our pricing page for current rates and features.

You may cancel your Pro subscription at any time. Upon cancellation, you retain access to Pro features until the end of your current billing period, after which your account reverts to the free tier. We do not offer prorated refunds for partial billing periods.

4. Acceptable Use

You agree to use Maxisnap only for lawful purposes. You may not use the Service to:

Capture, store, or distribute illegal content, including but not limited to child exploitation material, content that violates intellectual property rights, or content that violates applicable laws
Upload malicious files, malware, or content designed to exploit vulnerabilities in our infrastructure
Harass, threaten, or harm other individuals using content captured or shared through the Service
Attempt to reverse-engineer, decompile, or disassemble the Maxisnap application
Use automated systems, bots, or scripts to interact with the Service in a manner that degrades performance for other users
Resell, redistribute, or sublicense the Service without our written consent
Circumvent or disable any security or access-control features of the Service

We reserve the right to suspend or terminate your access to the Service if we reasonably believe you have violated these terms.

5. Intellectual Property

Your Content

You retain all rights to the screenshots and content you create using Maxisnap. We do not claim ownership of your captures. When you upload screenshots to our cloud, you grant us a limited license to host and serve that content for the purpose of providing the sharing functionality — nothing more.

Our Software

The Maxisnap application, including its code, design, branding, documentation, and all associated materials, is the intellectual property of Maxisnap and is protected by applicable copyright, trademark, and other intellectual property laws. Your use of the Service does not grant you any ownership of our intellectual property.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Maxisnap application in accordance with these Terms.

6. Cloud Upload Service

If you use Maxisnap's cloud upload feature, the following terms apply:

Uploaded screenshots are accessible via unique links. Anyone with the link can view the image.
Uploaded content is retained for 90 days and then automatically deleted. You may delete uploads at any time.
We reserve the right to remove uploaded content that violates these Terms or applicable law.
We do not guarantee 100% uptime or availability of the cloud hosting service. Uploaded content should not be your sole backup.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

Maxisnap is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
In no event shall Maxisnap, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
Our total liability for any claim arising from or related to the Service is limited to the amount you paid us for the Service in the 12 months preceding the claim, or $50 USD, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless Maxisnap and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

You may stop using Maxisnap at any time by uninstalling the application. If you have a Pro subscription, you should cancel it through your account settings before uninstalling to prevent further charges.

We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination:

Your right to use the Service ceases immediately
Any uploaded content will be retained for the standard 90-day period, then deleted
If you had a Pro subscription, no refund will be issued for the remaining billing period
Provisions of these Terms that by their nature should survive termination (including Sections 5, 7, 8, and 10) will survive

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of a recognized arbitration institution, unless you are located in a jurisdiction where arbitration agreements are not enforceable, in which case disputes will be resolved in the courts of competent jurisdiction.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Maxisnap regarding your use of the Service. They supersede all prior agreements, understandings, and communications, whether written or oral.
